NO PURPOSE CREATES ANY OBLIGATION TO PROVIDE SERVICES.

5. CONSENT & LAWFUL BASIS (INDIA)

5.1 Processing is based on explicit consent under the Digital Personal Data Protection Act, 2023 (DPDP Act).

5.2 Consent may be withdrawn prospectively by written request; however, the Consultant may retain data as permitted by law.

5.3 Withdrawal shall not affect processing already lawfully undertaken.

6. FOREIGN DATA PROTECTION LAWS DISCLAIMED

6.1 The Consultant complies only with Indian data protection laws, including:

Information Technology Act, 2000;
IT (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011;
Digital Personal Data Protection Act, 2023.

6.2 Applicability of GDPR, CCPA, UK GDPR, or any foreign regime is expressly disclaimed unless contractually agreed in writing.

7. DATA SHARING & DISCLOSURE

Data may be disclosed:

to employees, advisors, consultants, or service providers;
to legal, regulatory, or governmental authorities;
to protect legal rights or defend claims;
pursuant to court orders or statutory obligations.

No disclosure shall be deemed a breach of confidentiality.

8. DATA STORAGE, SECURITY & RISK ALLOCATION

8.1 Reasonable security practices are implemented; however, NO SYSTEM IS INFALLIBLE.

8.2 You expressly acknowledge and accept risks of cyber incidents, breaches, or unauthorized access.

8.3 The Consultant disclaims all liability arising from such incidents to the maximum extent permitted by law.

9. DATA RETENTION

9.1 Data may be retained for as long as deemed necessary by the Consultant for:

business purposes;
legal protection;
regulatory compliance;
dispute prevention.

9.2 The Consultant is under no obligation to delete data upon request, except where mandatorily required by law.

10. USER RIGHTS (LIMITED)

10.1 Rights, if any, are limited strictly to those expressly provided under the DPDP Act.

10.2 Requests may be denied where permitted by law, including for legal defence or compliance.

11. NO THIRD-PARTY RESPONSIBILITY

The Consultant is not responsible for:

third-party websites or platforms;
unauthorized access caused by external actors;
actions of telecom providers, hosting providers, or intermediaries.

 

12. WAIVER & RELEASE

You irrevocably waive and release the Consultant from all claims, losses, damages, liabilities, penalties, or proceedings arising from:

data submission;
data processing;
data disclosure as permitted herein;
system or security failures.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law, total liability, if any, shall not exceed INR 1 (Indian National Rupees: One Rupee).

14. GOVERNING LAW & EXCLUSIVE JURISDICTION

This Policy shall be governed exclusively by the laws of India.

Courts at [City, State, India] shall have exclusive jurisdiction.

15. AMENDMENTS

This Policy may be amended at any time without notice. Continued use constitutes binding acceptance.

16. SEVERABILITY & SURVIVAL

Invalidity of any provision shall not affect remaining provisions, which shall survive.
